1. Agreement to Terms

By accessing or using WhichMethod (the "Service"), located at whichmethod.com, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

The Service is operated by Small Block LLC, a Delaware limited liability company ("Company," "we," "us," or "our").

2. Description of Service

WhichMethod is a goal-setting framework assessment tool that:

• Presents users with a series of questions about their real-life constraints and circumstances
• Matches users to appropriate goal-setting methodologies based on their responses
• Provides framework explanations and, for paying users, personalized instruction prompts for use with AI assistants

The Service includes both free features (basic assessment and framework matching) and paid features (advanced assessment, additional frameworks, and exportable AI prompts).

3. Eligibility

You must be at least 18 years of age to use the Service. By using the Service, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms.

4. User Accounts and Registration

4.1 No Account Required

The Service does not require user registration or account creation. Assessment responses and progress are stored locally on your device using browser localStorage.

4.2 Email Collection

• For the free assessment tier, you may optionally provide an email address. This email is stored only on your local device and is never transmitted to our servers.
• For paid purchases, your email is collected and processed by our payment processor, Stripe, and shared with us for order fulfillment and customer support purposes.

4.3 Data Portability

Because your assessment data is stored locally on your device, you maintain full control over this information. Clearing your browser data will remove your stored responses.

5. Purchases and Payment

5.1 Pricing

The Service offers a one-time purchase option for $7.00 USD (or such other price as displayed at checkout). This is a single payment, not a subscription.

5.2 Payment Processing

All payments are processed securely through Stripe, Inc. By making a purchase, you agree to Stripe's terms of service and privacy policy. We do not store your payment card information.

5.3 What You Receive

Upon successful payment, you receive:

• Access to the full 18-question advanced assessment
• Matching to all 13 goal-setting frameworks
• Personalized AI instruction prompts for your matched framework(s)
• The ability to download and export your instruction prompts

5.4 Delivery

All paid content is delivered digitally and immediately upon successful payment confirmation.

6. Refund Policy

All purchases are final. Refunds are not available after purchase unless absolute technical difficulties create a purchase state of an undeliverable digital product to user's device. Please reach out to support@onesmallblock.com for any issues.

6.1 Digital Product Nature

The Service provides digital content that is delivered immediately upon purchase. Due to the instant-access nature of digital products, we offer refunds under the following conditions:

6.2 Refund Eligibility

• Technical Issues: If you experience a technical problem that prevents you from accessing your purchased content, contact us within 7 days for a full refund.
• Dissatisfaction: If you are unsatisfied with your purchase for any reason, contact us within 7 days for a refund or resolution.

6.3 Refund Process

To request a refund, contact us at support@onesmallblock.com with your purchase email and a brief description of the issue. Refunds are processed within 5-10 business days to your original payment method.

6.4 No Questions Asked

We aim to resolve all refund requests fairly. Our goal is your satisfaction, not retaining payment for a product that didn't meet your needs.

7. Intellectual Property

7.1 Our Content

The Service, including its original content, features, functionality, design, text, graphics, and the selection and arrangement thereof, is owned by Small Block LLC and is protected by United States and international copyright, trademark, and other intellectual property laws.

7.2 Framework Research

The goal-setting framework analyses, syntheses, and matching algorithms provided through the Service represent proprietary research and methodology developed by Small Block LLC.

7.3 Your Use

You are granted a limited, non-exclusive, non-transferable license to:

• Access and use the Service for personal, non-commercial purposes
• Download and use your purchased instruction prompts with AI assistants for personal goal-setting purposes

7.4 Restrictions

You may not:

• Reproduce, distribute, or publicly display Service content without our written permission
• Reverse engineer, decompile, or attempt to extract the matching algorithm or methodology
• Resell, sublicense, or commercially exploit purchased instruction prompts
• Use the Service to develop a competing product

8. User Conduct

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to gain unauthorized access to any portion of the Service
• Interfere with or disrupt the Service or servers
• Transmit any viruses, malware, or harmful code
• Attempt to probe, scan, or test the vulnerability of the Service
• Use automated means (bots, scrapers) to access the Service

9. Disclaimers

9.1 No Professional Advice

The Service provides educational information about goal-setting frameworks and methodologies. It does not constitute professional advice (psychological, medical, financial, or otherwise).

The framework matching and recommendations are based on general research and your self-reported responses. Results may vary. You are responsible for your own goal-setting decisions and outcomes.

9.2 "As Is" Basis

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

9.3 No Guarantee of Results

We do not guarantee that any particular goal-setting framework will be effective for you, that you will achieve your goals, or that the Service's recommendations will be suitable for your specific circumstances.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL SMALL BLOCK LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR SEVEN DOLLARS ($7.00), WHICHEVER IS GREATER.

11. Indemnification

You agree to indemnify, defend, and hold harmless Small Block LLC and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or in connection with:

• Your use of the Service
• Your violation of these Terms
• Your violation of any rights of another party

12. Governing Law and Dispute Resolution

12.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions.

12.2 Dispute Resolution

Any disputes arising out of or relating to these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved in the state or federal courts located in Delaware.

13. Changes to Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will provide notice by updating the "Last Updated" date at the top of these Terms.

Your continued use of the Service after any changes constitutes your acceptance of the new Terms. If you do not agree to the modified Terms, you should discontinue use of the Service.

14. Termination

14.1 By You

You may stop using the Service at any time. Because your data is stored locally, simply clearing your browser data or ceasing to use the Service is sufficient.

14.2 By Us

We reserve the right to suspend or terminate your access to the Service at any time, for any reason, without notice. However, if you have made a valid purchase, you will retain access to your purchased content or receive a refund.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy and any other legal notices published on the Service, constitute the entire agreement between you and Small Block LLC regarding your use of the Service.
